Chapter VIII: Delegate Acts (Article 57)
This section outlines the process by which the European Commission can adopt delegated acts under Articles 31(6) and 43(2) of the regulation.
Delegation of Power: The Commission is given the authority to adopt delegated acts for five years starting from 17 January 2024. This authority will be automatically renewed for the same duration unless the European Parliament or the Council objects within three months of the renewal.
Revocation of Delegation: The European Parliament or the Council may revoke the delegation of power at any time. The revocation takes effect once it is published in the Official Journal of the European Union. This will not affect any delegated acts that were already in force.
Consultation and Notification: Before adopting any delegated acts, the Commission must consult with experts designated by each Member State. Once a delegated act is adopted, the Commission is required to notify both the European Parliament and the Council.
Objection Period: The delegated act will only come into force if neither the European Parliament nor the Council objects within three months of the notification. This period can be extended by an additional three months if needed.
